HOW TO APPLY FOR YOUR MARRIAGE LICENSE IN THE STATE OF GEORGIA.

Georgia residents who wish to get married in Georgia may obtain a marriage license in any Georgia County. Non-residents must obtain a marriage license in the County in which the marriage ceremony will occur. When it come to marriage license fees, protocol for obtaining an appointment with the county, or retrieving your marriage certificate after the marriage license has been sent in— every county in the state of Georgia differs.

Requirements for a Marriage License in Dekalb County, Georgia

  • Both applicants must come to the appointment at the DeKalb Probate Court.

  • You must provide proof of age. Documents that are accepted include, but are not limited to, a valid driver’s license, original or certified copy of birth certificate, valid passport, or valid armed forces identification card.

  • If either applicant has been divorced, you must present a final, stamped, sealed certified divorce decree(s).

  • If either applicant was previously married and the spouse died, you must present proof of death such as a death certificate or an obituary.

  • If either applicant presents a legal document in a language other than English, the applicant must attach a translation of the document by a certified translator.

  • $68.00 (includes one certified marriage certificate and shipping and handling).

  • Cash (no bills larger than $20), money orders, Visa, MasterCard, and Discover are accepted. Money orders should be made payable to DeKalb County Probate Court. No personal checks are accepted.

Lawrenceville, Georgia

The Probate Court has two offices on the first floor of the Gwinnett Justice and Administration Center located at 75 Langley Drive, Lawrenceville, Georgia 30046.

Marriage license applications are accepted at the Vital Records office located just past the elevators on the judicial side of the building. The office accepts marriage license applications Monday through Friday, excluding holidays, from 8:00 a.m. to 4:30 p.m.

At the time the marriage license application is filed, the parties must appear together in the

Gwinnett County Probate Court and provide the Court with the following:

1.    Proof of age by presenting one of the following: a birth certificate, driver’s license, baptismal certificate, certificate of birth registration, selective service card, court record, passport, immigration papers, alien papers, citizenship papers, armed forces discharge papers, armed forces identification, or hospital admission card;

 

2.    Affirmative evidence of the most recent divorce by presenting a final, stamped, sealed divorce decree;

 

3.    No one under the age of 17 shall be issued a Marriage License in the State of Georgia for any reason. A 17 year old may be issued a Marriage License IF ALL OF THE FOLLOWING ARE MET:

A.    A Petition is granted in Juvenile Court for Emancipation and a Certified Copy of such Order is presented.

B.    15 days have passed since the date of the Order Granting Emancipation was granted.

C.    The Older Party to the Marriage is no more than 4 years older than the younger party.

D.    Applicants have completed Premarital Education according to § 19-3-30.1.

 

4.    A signed and dated certificate for those persons claiming to have completed premarital education. Premarital education is not required for marriage; and

 

5.    Proof of death of a former spouse such as death certificate, obituary, or other documentation.

If the parties present a legal document that is in a language other than English, the Applicant must attach a translation of the document by a certified translator.

Please note: Parties have a legal obligation to provide current, correct, and full legal names on the marriage license application. If the information provided on the marriage license application is not correct, the applicants may have problems with other government agencies, such as Immigration, Social Security, or Driver’s Services, and may incur additional costs and time delays when seeking to have the application for marriage license corrected.

Obtaining a Marriage License in Cobb County

Any Georgia resident may apply for a license in any county in Georgia. However, if neither applicant is a resident of Georgia, you may only obtain your license in the county where the ceremony is performed. The license does not have an expiration date.

Both parties must be present in order to obtain a marriage license. Pre-marital blood test results are no longer required in the State of Georgia.

Identification: You must have proof of age by presenting one of the following:

  • Valid driver’s license

  • Original or certified copy of birth certificate

  • Valid passport

  • Valid military ID

The marriage license fee is $56.00 (cash/credit/debit) or $16 (cash/credit/debit) only if you provide to the court a Certificate of Completion for a Qualified Premarital Education Program with at least six hours of instruction involving marital issues. The premarital education must be completed within 12 months prior to the application for a marriage license and the couple must undergo the education together. Applications for Marriage Licenses are accepted Monday through Friday from 8:00 am - 3:30 pm. Please take into consideration that it normally takes 20-30 minutes to complete the marriage license application; therefore, please arrive at the Court with enough time to accomplish this process.

Probate Court does NOT perform marriage ceremonies.

  1. Both applicants must be eighteen (18) years of age or older, or emancipated.

  2. Both applicants must appear in person and present a valid driver's license, Government issued ID card or passport for identification. (If the applicant’s ID has expired, they may also present a certified, original birth certificate in addition to their expired photo ID. All birth certificates must be translated.)

  3. If either Applicant has been divorced or a spouse has passed, the applicant(s) must present a certified copy of the Final Divorce Order or Death Certificate at the time of application. Plain copies will NOT be accepted. Contact the court where the divorce was finalized to request a certified copy.

  4. Translators are not provided by the Court. The Applicants are responsible for providing their own translators when needed and the translator must be 18 years of age or older. This individual must possess a valid photo ID. The translator will be required to sign an affidavit.

  5. If either Applicant is a resident of the State of Georgia, the Marriage License may be issued in any county in the State and the couple may be married in any county of the State. If neither Applicant is a resident of the State of Georgia, the couple must be married in Clayton County only.

In order to qualify for the reduced fee, the couple must provide the Court a signed and dated certificate of completion of a qualifying premarital education program. The Court has an acceptable Certificate which you may take to the premarital education provider.

What do I need to apply for a marriage license?

Due to current health conditions, the number of individuals present at one time in the office is limited and masks are required in the Clerk's Office because of close quarters and two-way foot traffic in public areas. 

You may call their office at (770) 781-2140 to have a marriage application packet to be emailed to you.

Once your license is ready to be picked up, you will be contacted. This can minimize your wait time in our office to process your application.

Both parties must appear with valid ID (driver's license or birth certificate). If divorced, it is not necessary for you to bring in a copy of your final decree of divorce; however, you will need to provide the date of the final decree along with the county and state in which the divorce was finalized. and you should have a certified copy of the final decree in your records. 

Applicants must be at least 18 to apply without parental consent.

What is the fee for a marriage license?

The license fee is $56.00 payable by cash, check, or credit/debit card. If using a credit/debit card, there is a 4.5% convenience fee charged by the credit card processing company and added to the total amount. The fee is reduced to $16 upon presentation of the Court form certifying pre-marital counseling. The form and requirements may be obtained from the Forms section below, the Probate Court office in person or by email.

How can I get copies of my marriage license?
